Terms of Entry
THE THIRD ANNUAL THANK YOUR VET FOR A HEALTHY PET® CONTEST OFFICIAL RULES NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. 1. The Contest The third annual "Thank Your Vet for a Healthy Pet®" Contest (the "Contest") is jointly sponsored by the Morris Animal Foundation; Hill's Pet Nutrition, Inc.; and BowTie, Inc., publisher of the DOG FANCY, CAT FANCY and Veterinary Practice News magazines (collectively, the "Sponsors") and is for the purpose of honoring the skills, dedication and invaluable services exhibited by licensed, practicing veterinarians within the United States caring primarily for companion animals. If you think your veterinarian is the best in America, nominate him or her for the Contest by submitting a short essay letting the Sponsors' judges know why you think your veterinarian is the best. Only one nominating entry allowed per submitter, however, an eligible veterinarian may be nominated by multiple submitters. The Contest is open to accept nominating entries from 12:00 a.m. Eastern Standard Time (EST) on July 1, 2009, through 11:59 p.m. EST on August 31, 2009 (the "Contest Nomination Period"). 2. Eligibility Pet owners or any other interested persons eligible to submit a nominating entry in the Contest must be legal residents of the United States and at least 18 years of age as of the date their nominating entry is submitted. Veterinarians who are licensed to practice and are actively practicing veterinary medicine within the United States for primarily companion animals (dogs and cats) are eligible to be nominated. Employees, officers and directors of the Sponsors and their respective parents, subsidiaries and affiliated companies, successors and assigns, and promotional agencies, as well as each of their respective immediate family members (spouses, parents, siblings and children) are not eligible to participate in the Contest (either as submitters or as nominees). 3. How to Submit Your Nominating Entry Nominating entries must be submitted within the Contest Nomination Period in the form of an essay composed of 300 words or less, telling the Sponsors' judges why you believe your nominee is the best veterinarian in America. Your essay should address four areas: (a) the veterinarian's outstanding care and treatment to pets; (b) commitment to the human-animal bond; (c) service to the community; and (d) devotion to the veterinary profession. Only one nominating entry may be submitted per person. All nominating entries must include the name, address, phone number and (optional) email address of both you and the veterinarian you are nominating. Nominating entries may be submitted one of two ways, either: (a)electronically by visiting the web site www.thankyourvet.org and fully completing the nominating entry form. All electronic nominating entries must be received no later than 11:59 p.m. EST on August 31, 2009; or (b)by mailing in your nominating entry via regular United States post office mail addressed to Morris Animal Foundation, Thank Your Vet for a Healthy Pet Contest, 10200 East Girard Avenue, Suite B430, Denver, Colorado 80231. All nominating entries written in long hand must be legible. All U.S. mail nominating entries must be postmarked no later than August 31, 2009. Nominating entries that do not contain the required information or do not comply with the eligibility and delivery requirements of the Contest will be disqualified. All nominating entries received during the Contest shall become the property of Sponsors and will not be acknowledged or returned. By submitting your nominating entry, you acknowledge that your essay constitutes your original work and does not violate the copyrights, privacy rights or any other rights of third parties, and you also grant Sponsors and their promotional agencies an irrevocable, unrestricted, royalty-free, worldwide right to use, copy, retain and publish your essay and nominating entry information (including name and city/state), in whole or in part, in any media whatsoever, for editorial, advertising and marketing purposes connected with the Contest. If you cannot make the foregoing acknowledgement and/or if you do not want to grant Sponsors the foregoing rights of use and publication, do not submit a nominating entry. 4. Winner Selection One (1) nominated veterinarian will be named the national winner, and four (4) nominated veterinarians will be named as runners-up. All submitted nominating entries will be divided into one of five regions of the United States: Northeast States, Southeast States, Midwest States, Northwest States and Southwest States. The division of the 50 United States and District of Columbia into the five regions shall be as set forth on the web site www.thankyourvet.org. On or about September 20, 2009, the Sponsors' panel of judges will review all eligible nominating entries received within the Contest Nomination Period and will select, at their sole discretion, the best nominating entry from each of the five (5) regions. Then the Sponsors' judges will select, again at their sole discretion, the best nominating entry from the five regional winners, and this nominee will be named the national winner, with the remaining four being named as runners-up. The judges' decisions are final. The odds of your nominating entry being selected as a winner in the Contest will depend on the number of eligible nominating entries received during the Contest Nomination Period. Both the persons submitting the winning national and regional nominating entries and the winning nominees will be notified in writing of the Sponsors' judges' selections and will be required to sign and return to Sponsors an Affidavit of Eligibility and Publicity/Liability Release verifying that they meet the eligibility requirements of the Contest and that they release Sponsors from all liability in connection with the Contest and also permit Sponsors to use their names, cities/states and likenesses for purposes of publicizing the results of the Contest. Signed affidavits from both the person submitting the nominating entry and his/her nominee must be received by Sponsor within fourteen (14) days from the date of Sponsor's written notification of winning. Failure to do so within the time period allowed will result in the nominating entry being declared void and the Sponsors' judges selecting an alternate winner. 5. Prizes The national winner will be named a co-sponsor of one of the available Morris Animal Foundation's animal health studies of his/her choosing. The national winner and regional runners-up will each receive a travel package to attend the 2010 North American Veterinary Conference (NAVC) to be held in Orlando, Florida, which includes: Two (2) nights/one room hotel accommodations at the Gaylord Palms Resort or comparable (January 15 & 16, 2010) for winner and one guest; Coach class round trip air transportation for winner and one guest; Meal/miscellaneous expense per diem of $100/person/day for winner and one guest (maximum $300/person) Complimentary NAVVC conference registration for winner and one guest The national winner and regional runners-up will each additionally receive a commemorative plaque and will be recognized and honored before their peers at a luncheon during the 2010 NAVC on January 17, 2010, and additionally will be featured in the January 2010 issues of Veterinary Practice News, DOG FANCY and CAT FANCY magazines. All arrangements for the NAVC travel package must be made through Morris Animal Foundation's travel agent by November 15, 2009. A check for meal/miscellaneous per diems will be provided to each winner only upon the check-in of the winner and his/her guest at the NAVC. The approximate retail value of the prizes for winning veterinarians is $2,300.00. Acceptance of any of the foregoing prizes by the winning veterinarians constitutes their agreement to be bound by these Official Rules and their consent to use their name, city/state and likeness, without further compensation except where prohibited by law, by the Sponsors and their promotional agencies and licensees for editorial, advertising and marketing purposes in connection with the Contest. Persons submitting the five winning nominating entries will each receive a coupon for one free large bag of any Hill's® Science Diet® brand pet food (an approximate retail value of $40). Such prize shall be mailed to the submitter upon Sponsor's receipt of both the submitter's and his/her nominee's signed Affidavits of Eligibility and Publicity/Liability Release. All nominated veterinarians will receive a nomination certificate. Prizes awarded through the Contest are non-transferable and no prize substitutions will be made except at Sponsors' sole discretion, who reserve the right to substitute a prize with another prize of equal or greater value. Sponsors are responsible for sales tax related to any prize awarded in the Contest, but the winners are solely responsible for all other federal, state and local taxes, including income taxes, associated with receipt and use of the prizes. 6. General Conditions Neither Sponsors nor its promotion agencies shall be responsible or liable for: (a) lost, illegible, stolen, garbled, incomplete, misdirected, postage due, damaged or failed electronically submitted nominating entries, and such nominating entries shall be considered disqualified (proof of emailing a nominating entry or connection to the Sponsors' web site is not considered proof of delivery or Sponsors' receipt, of a nominating entry); (b) telephone, electronic, hardware or software program, network, internet or computer malfunctions, failures or difficulties; (c) errors or delays in any hardware, software, servers or data transmission; (d) any condition caused by events beyond the control of the Sponsors or their promotional agencies which may cause the Contest to be disrupted or corrupted; (e) any losses or damages of any kind resulting from or arising out of acceptance or use of the prizes or from participation in the Contest as a submitter of a nominating entry or as a nominee; or (f) any printing or typographical errors in any materials associated with the Contest. Sponsors, at their sole discretion, may prohibit a person from participating in the Contest (either as a submitter of a nominating entry or as a nominee) if that person shows a disregard for these Official Rules or acts: (a) in a manner Sponsors determine not to be fair or equitable; (b) with an intent to annoy, threaten or harass any other participant or any of the Sponsors; or (c) in any other disruptive manner. Sponsors reserve the right in their sole discretion to cancel, terminate or modify any aspect of this Contest not capable of completion as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized human intervention, systems malfunctions or technical failures or difficulties, or other causes beyond the control of the Sponsors or its promotional agencies that may corrupt or affect the administration, security, fairness or proper play or conduct of the Contest. Neither the Sponsors nor its promotional agencies accept responsibility for change(s) to hardware or software resulting from accessing information for this Contest. By submitting a nominating entry in this Contest, you agree to release and hold harmless the Sponsors and their respective parents, subsidiaries and affiliated companies, successors and assigns, and promotional agencies ("Released Parties") from and against any claim for damages or losses or cause of action arising out of your participation in or attempt to participate in this Contest or the receipt or use of any prize received as a result of participating in this Contest. 7. Personal Information Personal information of yours and your nominee received as a result of your submitting a nominating entry in this Contest will only be used by Sponsors and its promotional agencies for purposes of administering this Contest. 8.
